Case Description - June 25, 2004 the Akiyama family was driving southbound on Missouri Highway 13 when they were stuck by a pickup truck driven by Foote. Foote had failed to yield and pulled into the path of the Akiyama vehicle. The driver of the Akiyama vehicle sustained a fractured elbow requiring surgery. A passenger sustained a laceration to his lip requiring sutures and the two children received soft tissue injuries. The defendant settled the personal injury case prior to trial.
