Case Description - Joyce Lane was diagnosed with cancer. Her treating physician prescribed a medication manufactured by Squibb for the treatment of cancer. The prescription for the medication was filled by Robert Courtney at his pharmacy. It was later determined that Robert Courtney was diluting the medication for Ms. Lane along with possibly as many as 1,000 other customers at his Kansas City pharmacy. Courtney is serving a 30-year prison sentence after pleading guilty to 20 felony counts of tampering, adulteration and misbranding cancer drugs. Pharmacists Mutual Insurance Co agreed to a $35,000,000 settlement. Assets were taken from Robert Courtney totaling approximately $10,000,000 to pay off the victims. Drug companies Eli Lilly and Co. and Bristol-Myers Squibb Co. set up a $71,000,000 million settlement pool for the payment of victims.
