Case Description - On May 3, 2007 Fred Shaw was driving a mini-van owned by his former employer, FTF. For unknown reasons, the vehicle crossed the median on US 71 in Cass County. The defendant's mini-van struck head on the plaintiff's vehicle, killing Larry Shaw. Part of the defense was that there was no negligence on behalf of the defendant driver, who also died in the accident, because the wreck was caused by a major health event. Plaintiff was prepared to make claims for negligent entrustment against his former employer and owner of the vehicle, defendant FTF, based upon defendant's prior health issues.
The insurance company had to be forced to understand that even though Mr. Shaw was a 69 year old retired individual, the case still had important value. In addition to employing an economist, extensive evidence and discovery was presented on the important family relationships, loss of guidance, loss of services and loss of companionship. Mr. Shaw was a wonderful husband, father and grandfather.
