Darrel Mathia, a Missouri construction worker was killed when a semi truck back into him, crushing Mathia between the truck and a crane. Spellman, Mathia's daughter, brought a wrongful death suit claiming the trucks had faulty breaks. The Defendant XYZ Trucking settled for $1.4 million. The daughter brought the law suit as a means to avoid a large worker's compensation lien.
